The Supreme Court has refused to hear a petition concerning the Department of Homeland Security’s secretive internet and cellphone killswitch program.

(ANTIMEDIA) United States — On Monday the Supreme Court declined to hear a petition from the Electronic Privacy Information Center (EPIC) that sought to force the Department of Homeland Security to release details of a secret “killswitch” protocol to shut down cellphone and internet service during emergencies.

EPIC has been fighting since 2011 to release the details of the program, which is known as Standard Operating Procedure 303. EPIC writes, “On March 9, 2006, the National Communications System (‘NCS’) approved SOP 303, however it was never released to the public. This secret document codifies a ‘shutdown and restoration process for use by commercial and private wireless networks during national crisis.’”

EPIC continues, “In a 2006-2007 Report, the President’s National Security Telecommunications Advisory Committee (‘NSTAC’) indicated that SOP 303 would be implemented under the coordination of the National Coordinating Center (‘NCC’) of the NSTAC, while the decision to shut down service would be made by state Homeland Security Advisors or individuals at DHS. The report indicates that NCC will determine if a shutdown is necessary based on a ‘series of questions.’”

Despite EPIC’s defeat at the hands of the Supreme Court, the four-year court battle yielded a heavily redacted copy of Standard Operating Procedure 303.

The fight for transparency regarding SOP 303 began shortly after a Bay Area Rapid Transit (“BART”) officer in San Francisco shot and killed a homeless man named Charles Hill on July 3, 2011. The shooting sparked massive protests against BART throughout July and August 2011. During one of these protests, BART officials cut off cell phone service inside four transit stations for three hours. This kept anyone on the station platform from sending or receiving phone calls, messages, or other data.

In July 2012, EPIC submitted a Freedom of Information Act (FOIA) request to the DHS seeking the full text of Standard Operating Procedure 303; the full text of the predetermined “series of questions” that determines if a shutdown is necessary; and any executing protocols related to the implementation of Standard Operating Procedure 303, distributed to DHS, other federal agencies, or private companies.

After the DHS fought the FOIA releases, a district court in Washington, D.C. ruled in EPIC’s favor, but that ruling was later overturned by the court of appeals. The appeals court told EPIC the government was free to withhold details of the plan under the Freedom of Information Act because the information might “endanger” the public. In 2015, the digital rights group asked the Supreme Court to review the ruling by the federal appeals court.

With the Supreme Court’s refusal to address EPIC’s petition, the issue seems to have reached a dead-end. The American people are (once again) left in the dark regarding the inner-workings of another dangerous and intrusive government program. It is only through the hard work of activists and groups like EPIC that we are at least aware of the existence of this program — but knowing bits and pieces about the protocol is not enough. In order to combat such heavy-handed measures, we need to have access to the government’s own documents. Hopefully, there is already a whistleblower preparing to release these details.

What we do with the information we do have is up to each of us as individuals. We can sit back and watch the United States further devolve into a militarized police and surveillance state — or we can spread this information, get involved locally, and create new systems outside of the current paradigm of control and exploitation.

A lot of this isn't new though keeping hidden the wording to SOP 303 is troubling and just as bad as this law! I read were people are blaming obummer for this one, this assumption is incorrect Bush is the one that put in place SOP 303

FYI - in perspective
NCC 1983 (national coordinating center for telecommunications) including the
critical infrastructure protection (CIP) both becoming law in 1984 both part of EO 12472 signed in law in 1984

Both the NCC and EO 12472 were expanded in directive 63 (PDD-63) (63 FR 41804) in 1998 that included IAW (indications assessment warning) SOP 303 (kill switch) is more or less the child of CIP (critical infrastructure protection) signed in law in 2000 that was part of PDD-63.
 
That all said, there is a very valid reason why DHS would and should have such a switch. To completely halt a foreign web attack. Makes perfect sense.

Like all weapons though, all that matters is who it is pointed at. The weapon itself is neither good nor bad, it's all up to the shooter.

Shutting down the Internet (as the US govt) wouldn't seem to be all that difficult, simply shut down the hubs. HAM is another story though, but I suppose it wouldn't be too difficult to jam major areas. Of course, yes, if they were so inclined, could easily trace undesirable HAM broadcasters and then handle them individually, but there isn't a quick kill switch like you could do with the Internet.
 
if you didn't hear - there was an EO signed by Prez Trump strengthening the 1st Amendment Right in regard to the various social media's "censoring" >>> no more BS crap deleting in favor of the liberals & the DNC

1917, World War I Congress ordered all amateur radio operators to cease operation and even dismantle their equipment. during WWII Congress suspended all amateur radio operations followed by War emergency radio service that replaced RACES. If you operate outside the parameters of the law you are not a HAM. So, by law you can be shut down, the Government own the airways and grants licenses to operate on the airways.
 
RACES wasn't around during WW2. There was no dismantling of equipment, though the government did ask for donations of transmitters and receivers at the early onset to help with the lack of any radio equipment, (Hams on the cutting edge of technology, the whole reason for the service).

Orders to disconnect all radio apparatus came from M. B. West, radio censor for the United States Government for this district, on April 9th, and the sheriff of Erie County was notified on the same date in a telegram from Governor Whitman to dismantle all wireless stations in this county. He at once got his sixty deputies together and gave them written orders to search for all radio apparatus and report their findings to him.
On April 16th, a wireless station was installed in the Federal Building to be used for the purpose of detecting amateurs who had not obeyed the Government's orders to dismantle their stations. It's installation was directed by Radio Engineer Leary of this city. The local commercial station that had been taken over by the naval authorities was re-opened for commercial business. It is being operated as a naval station and will be subject to censorship at all times.
April 17th showed that three hundred radio stations in Buffalo and vicinity had been dismantled since word came from Washington and it was especially pleasing to Radio Gunner M. B. West. The Police Department joined forces with the sheriff and the radio department, and the reports from captains of several stations (police) showed that up to the morning of the 17th, twenty-one additional outfits had been dismantled. We are all anxiously awaiting the word that will give us permission to again reopen our stations, and we hope that it will be soon. Meanwhile, let us fly old glory at the top of our masts in place of the aerial and patiently await the outcome of Uncle Sam's entry into this great war.
 
So by your own admission, your initial statement " Ham can be shut down just as fast as the Internet and just as traceable when TXing ", was incorrect.

I'm familiar with all of what you've posted, and then some. I've only been licensed 30 years though.

My point to your statement is it can't be done with the "flip of a switch" like you stated. BTW, "HAM" is not an acronym and shouldn't be all caps...73.

Flip of a switch is figure of speech to illustrate the speed at which it can be done. Doesn't have to be an acronym for capping, you being a HAM knows the ARRL and QSL mags have capped HAM in it's publications from time to time, sometimes they will print Ham, ham. I cap it out of respect of the hobby.

Is DXing of NVIS doable with satellites now, or does there still need to be ground equip in the area?

Would NVIS while moving (vehicle) be a way around getting a lock?

I’m not too worried about it, as if the .gov is looking for “pirate radio operators” they will have busted my door down long ago for owning guns, being former .MIL, white patriotic, follower of YHVH, anti-vaxer, etc.

I’m sure my door will be knocked on for one of those horrendous traits long before wanting to silence my NVIS transmissions.
