I have a turd muffin for a neighbor. Our bull got out about a month ago now and did cross into the neighbors yard. I didn't realize at the time. I saw him out when I drove in from work. Called and Charlie reluctantly came in our front gate cause my milk cow was in heat and he was by her pasture. The neighbor did come over a few days later and asked if one of our cows had gotten out. I told him yes, which one and the probable reason on the why. Neighbor was nice as could be that day but my BIL was over helping in the garden so met the neighbor. Told me that he saw the hoof print because its been wet, but before I could say I had sand that i could fill them in with he said he was not worried about it. As I said nice as could be, . . . he is a camillion and just putting on a show . . . for me? or my BIL? Thinking BIL Last interaction I had with him was a couple years ago when I dropped off some rice to a neighbor and his patrol car was parked outside the house. I'll be honest and say that I was very matter of fact and left. Sorry but when he started testing inappropriate, that was it for me.

We just had a rain storm of about 5 inch overnight. The neighbor damned up the culvert n 2 places in his yard to prevent our drain off. We are at the dead end so we were the only ones effected. Hunny and I try not to have anything to do with this neighbor, but he makes it very difficult. To top it off, he works for the sheriff's department and has gotten away with a lot of stuff.

Hunny called and talked to THE sheriff. She just got elected last year and my hunny and her have been known each other for years now. Last incident was thru her and thinking he just got talked to, but do know she is aware of him and is not thrilled with his doings, which is not only with us. This feud has been going on for over three years now. He is not faithful and I have turned him down. He calls sheriff dept when he thinks hunny is going down the road too fast. Had county put up 20 MPH sign about 20 ft from our front gate, etc.

Told my hunny tonight, it is one thing to mess with us, but now he is messing with MY babies. If I see this man I will let him have it at this point. The pastures drain down that line and if not it creates major problems, mainly foot rot when pastures are wet for a long time.
 
I dont think he can deliberatly block water drainage. Its the same as damning up a water way or preventing reasonable access to ones property. I would ask the county land office about the law. If he doesnt comply, take him to court for any vet bills and livestock loses.
 
It’s a tough situation with a bad neighbor. Mine used my property for a trash disposal, and even ran his washing machine drain into my yard. We are civil at this point, but have had words too many times. Some people are just rotten and best ignored as much as possible. The problem with starting a lawsuit over something like drainage or illegal dumping, you are still going to be living next to this person and they are going to constantly look for ways to make you miserable. My advice is to get a good look at the land and do your best to find another solution. Maybe a retention pond? A pump to move water into the roadside ditch? I have a feeling starting a war with a nasty, cheating sheriff isn’t going to make your life easier.
 
Hunny said he is taking the trackhoe out and digging ditches in the pastures. We are expecting more rain this week. So far we haven't touched the cinder blocks he used but I will be moving them before this next rain starts.
 
I think you have every right to clean the ditches out in order to drain your property. Usually the county does a pretty good job of cleaning the ditches.
Having a problem neighbor can be very difficult sometimes. Years ago I had a pain-in-the-### neighbor. One time he cut a few trees on my property. So I went on his property and cut 3 times as many trees and skidded them all down to my sawmill. Another time he parked his crappy car blocking my mail box. I asked him not to, and he parked there again. So I took my tractor with the log forks down and picked his car up and not so gently moved it. He never parked there again or cut any of my trees.
 
We have to be very careful with this turd. If we do anything considered illegal you can bet he would file on us in a heartbeat. We could only get about half a ditch dug out in the cows pasture located by the front gate but at least that should help. It's just too wet. It will now drain out on the left side of our gate, which is where he dammed up. If the water gets high enough, it will flow over his rock drive into the ditch on the other side. That's the best we can do for now. Tomorrow he goes back to work I think. We 'll see if the Sheriff talks to him and he removed his cinder blocks.
 
if the drain is part of a right of way,just go down and clean it out,take pictures before doing so and then level a complaint to the sheriffs office and also talk to zoning
 
We did take pictures and sent to the sheriff. I will move them before the rain, but I am hoping he will do the right thing. Just not holding my breath.
 
So today when we came back from getting mulch, the blocks were back and we also had rain last night and again today but not heavy. Not sure if he had the write up yet or not. The week he was scheduled to go back to work his son beat the crap out of him which sent him to the hospital for a few days. Pictures taken again, sheriff talked to. Apparently there is a law against blocking drainage and another one against harassing which is what he is doing. I'm not thrilled about the situation but he needs to know he can not get away with this without consequences.
 
It's an unfortunate situation you're in currently, I hope eventually you and your A hole "neighbor" can come to a mutual agreement over the whole deal.

I would say if you have a known water drain off situation that occurs with any frequency, take advantage of it and retain it on your property, I think that was mentioned. Apologies if I'm mistaken, but that's what I would do. Develop an area for it to go where you can take advantage of it....take what he doesn't want.
 
We talked to the County Commissioner on Monday. He came out here on Wed and he personally moved the blocks. Neighbor was not home and wouldn't answer his cell phone when commissioner tried to call to say he could not do that again. Commissioner told hunny if he does it again get in touch with him and he'll get with Sheriffs department. We'll see how this route goee. Rains start again this evening into tomorrow morning. Neighbor still hasn't been back to work since getting beat up so doesn't know of the two complaints against him yet.
 
You are obviously dealing with in the right way. Really glad the Commissioner has got invloved and seen what the problem is. With luck, this should be the end of it. I've dealt with asshole neighbours too, it wears you down something awful and I can sympathise.
 
I think you are doing the right thing. Do not engage this bully, don't call him, don't communicate with him in anyway except through a attorney or officials. Just let your officials do their jobs. You can't reason with crazy. Keep precise records, dates and times and lots of photos. You need to keep this even if you think you will never need it. It is good insurance and you would be a wise person to document the happenings. If you haven't done this yet, then start now and write down what has happened in the past in the best order that you can. You would never be sorry you did, but you could be very sorry if you didn't. Good luck. I hate asshole neighbors.
